You can carry the handgun anywhere within the state (except certain buildings and certain events), except it is a permit to carry only, not use.true not to familiar with the case. also not sure how lawas work in america but if you have a permit for a handgun does the law say that your only allowed to use it on your property and cant be carried off. i dunno the laws. but if he killed the kid shouldnt he have been arrested for manslaughter regardless if it were self defence until proven in court otherwise and not been able to just walk home after the incident. and if roles where reversed im pretty sure trayvon would have been sentenced the next day to life behind bars.
The only times you are permitted to use the gun (separate laws from the law allowing you to carry the gun) is in cases of self-defense where you feel that if you do not act immediately, you may lose your life or suffer serious bodily injury; in order to prevent a forcible felony (Armed robbery, rape, murder, etc...) occurring; to protect your property; or to defend another person where, if you were in their position, you believe they would use the gun to prevent their own loss of life or their own serious bodily injury.
Zimmerman's case (from his statements) will most likely proceed as follows: He encountered Treyvon and went to ask him why he was in the neighborhood. Trevyon became hostile and began reaching for something. Fearing it was a weapon, I (Zimmerman) drew my own weapon. Upon drawing my weapon, Treyvon punched me in the face and began trying to take my weapon. Fearing that I was losing control of my weapon, I fired it in order to prevent Treyvon from retrieving it and using it against me.
If that isn't the way he says things happened, and the gunshot location doesn't corroborate this, it's going to be extremely difficult to prove he was justified in shooting an unarmed person.
He needs to establish 1. Why his weapon was out in the first place. and 2. why he felt that he would lose his life or experience serious bodily injury if he didn't pull the trigger.
The reality is it needed to be ruled a Justifiable Homicide by a magistrate because Zimmerman's statements alone are not enough for evidence.
