Death's God has a weakness?

The Sandaime Hokage sealed Hashirama. Kabuto told that souls that were sealed can't be used anymore. So:

1- When Tobi show the Gedou Mazou to Kabuto, he told that one part from Hashirama (without conscience) was there;
2- Edo-Madara has a part from Hashirama in his body (and show the Hashirama's face to the five kages).

If a sealed sould can't be used anymore, how this situations that i remembered can be possible?

Anyway the technique itself does have its weaknesses like anything else
