Did you even read my post? I was talking about Gaara not having the intent of trying to kill Sasuke. Sasuke didn't want to fight Gaara either..

What are you talking about, man? He supposedly shed a clownish tear and attacked with three Jounins - Darui, Temari, and Kankaro - to finish him off. He wasn't expecting Sasuke to pull out a Level 2 incomplete form. Had he not had a Susano'o before him, he would have died. Gaara had every intention to kill him at that point.
