It's an idea. Or maybe it's even simpler, as in he just can't. Doesn't he send the part of him into another dimension? So if the space it was supposed to come back in was occupied, it just wouldn't be able to. Or it would be destroyed.

I thought that was just Sakura or Kakashi's hypothesis. I don't think it was ever confirmed by Tobi or anyone else though. Konan and Tobi explained his warping (dimensional transfers) but I'm not sure if Tobi's intangibility has ever been explained yet.

But you can bring up the fact that Kishi's made Tobi's S/T techs too OP so he's not having Tobi use it for all the crazy things people have thought up. For example: the question can be raised as to why he didn't kidnap Naruto when he was a helpless kid.

Regardless, I don't think we'll be seeing Tobi do this at all.
