he is not an uchiha because his sharingan cant be deactivated
kisame when he saw the face of tobi he said ''so you are the mizukage i mean madara'' so madara was the 4th mizukage but do kisame know the face of madara ? i dont think so
kisame know about the sharingan that only itachi ,sasuke ,kakashi and madara ho have sharingan and when he saw the sharingan of tobi he know that he is madara
but in chapter 455 Danzo has a sharingan as well
and tobi look like danzo ( the hair and the position of sharingan eye and he hide the part that tobi show i mean the sharingan)
so i think that tobi is danzo the student of madara and he took the eye after his death (in the fight between madara and shodaime ) and he was the 4th mizukage because yamato said that he know that danzo was making a special training in Kirigakure
so danzo is tobi the leader of akatsuki and the hokage and the kage of all kage
