Equality isn't justice:
You have two children, the elder goes to high school while the other is in elementary.
The elder needs to take a bus to reach his high school while the younger only needs to walk a few blocks.
If want to treat them with justice you would have to give the elder more money, for the bus and for lunch.
But if you want to treat them equally you would have to give them the same amount which is either more than necessary for the younger, or unfair for the older as you either give them both money enough for lunch only and neglect the elders need for bus money OR give the younger more money than what he should have thus making it even more unfair for the elder.
Living equally is a thing, living in justice is another.
If there's a solution that does both sides justice, then that's the best solution.
