Because Itachi has essentially the same jutsu edo or not while Madara has jutsu as an edo he never had in life. Nagato never broke the edo tensei like Madara and Itachi did.

As far as Im concerned when he took advantage of the situation and broke the Edo tensei he became valid for Top 10 lists.
