Should I go to court?

Ok. Several things. I have to go to court on tuesday because "Failure to dim highbeams (Bright lights) behind a cop" I was about 3 cars behind her. BUT
I have school that day and really dont want to miss it but i dont have.. Or rather say dont want to GIVE them 100bucks.
the fine is $98

I had a preg girl (my sister) in the car when it was dark outside and I have bad eye-sight in the dark
Also the lady wrote the wrong date on it (Jan 22, 2012) when it should have been 2013. My mother and stepdad said I can fight that and i will most likley win. but my thing is... I dont want to miss class... If anybody have valid info.. Will it be certain they will pretty much throw the case out cause of the wrong court date.. or what?
hey Teno I work with law enforcement. Most likely the case has to be thrown out because she dated it wrong but definitely show up to court. I mean it's only a $98 fine and it's either that or not show up and have a warrant out for your arrest.

So to be sure I turn my high beams on. I always turn them off with oncoming traffic so i never blind nobody.
I was behind them by like 3 cars so it shouldnt have bothered none
and to top it off
My sister is preg and I had to drop her off to go to the doctor.. No offense to no officer or no judge. I can give a damn about the law over my life. I wasnt aware of that law and to me i call BS (I aint gonna bitch) but Its better to be safe than sorry.. I was following behind her for about. 30mins.. she then randomly decide to pull me over. SOB. U_U anyways..... I have more than enough grounds.

With the attitude you're displaying right now, I'll tell you exactly how I'd rule on this:

Bad eyesight? Your current license is suspended and you must undergo an eye exam before having your license reinstated with any restrictions properly and accurately marked. As they clearly aren't, now.

The law is x feet (I believe, in my state of Missouri, it is around 250 feet following; 500 feet oncoming).

and to top it off

You had to do nothing. You chose to take on a responsibility that put you in conflict with your physical abilities that resulted in a driving hazard this officer happened to witness and cite.

Or was this some kind of emergency? Did her water break? Enlighten me.

Whether you are aware of the law, or not, is irrelevant to the fact that the law exists and you broke it. The state is required to publish its laws for all to read. Can you demonstrate that you have been prohibited from viewing the laws?

With this, you just sealed your own case. You were consistently following too close with your brights on. The officer exercised discretion until, after 30 minutes, the officer decided that you were being such a hazard as to warrant time out of his/her day to pull you over and draft a citation.

You were given the benefit of the doubt by the officer for 30 minutes.

You may pay your fine and leave here feeling damned lucky I don't charge you with contempt of court or raise your fine to the maximum allowed under my authority. Get your eyes checked and your license updated with the proper restrictions (impaired vision typically only allows you to drive from sun-up to sun-down unless going to/from work and restricts you to a maximum speed of 45 mph... and they really prefer you to stay within city/county limits).

Your mistake is walking in there like you own the case.

You don't.

You own yourself and you own your side of the story. That's it.

Walk in there with the attitude you are displaying here, and you're just going to provoke the judge into making your day hell.

your eye sight is not the polices fault
does not matter if you bother people its the law, follow it
she was not giving birth or anything, there was no rush that is acceptable anyway vm and tell me what happens i really want to know ....

So you were 3 car lengths behind the cop or was there 3 cars in front of the cop. The length I think is suppose to be 250ft before you dim them. Why did you have to drive? That will be an important question that will be asked and you need to answer. Yes you were being safe but the law is the law.

Now the 1st thing you should do is see if you can reschedule the court date. You might be able to. The court date is for you to make a date to fight it in court right, or did you already go through that process. If it is the 1st one, I think you can. This way you wont have to miss your class.

If you can't, you have a really good chance of winning. It really depends on the judge however. I was able to get traffic school on a speeding ticket going 99 mph in a 55. You have a better defense then me. The cop writing the ticket for the wrong date makes her credibility worthless in a courtroom. They will more then likely throw it out. I say fight it.

Don't go to court. I had to go to court after a cop stopped me for riding on the shoulder of the road in New Jersey. I thought it was another lane. I didn't go, I ignored that mother****er.

You have to pay the fine, if you don't they'll put a warrant out, pile on more charges and add jailtime. You probably couldn't have talked your way out of it though, being nice to officers usually goes a long way since everyone treats them badly. A smile and plea for mercy goes a long way sometimes.

Dude, you'll win. Fuk the police. And the judges. Keep that hundred and go spend it on some sweet co-co-co-coooooocaine!
