On current state? I think Kenpachi mid-high diff, due to the fact he's training on learning his zanpaktou's name. I would think that if he wouldn't be able to beat Byakuya without, he'd be pushed so far to hear learn his zanpaktou's name and overwhelm Byakuya.

-Matsumoto got her entire torso ripped out and she still lived.
-Hiyori got cut in half and she survived.

Byakuya is a trooper. Not to mention his "death" had no significance. When a major character is killed their death leaves an impact on people around them and adds to character development. Someone as fan-popular as Byakuya wouldn't be killed in such a mundane way. This much should be common sense.

Byakuya was the central antagonist up to that point. That's why he faced Ichigo in the arc's final showdown. Nothing more.

If Kenpachi and Byakuya fought, Byakuya would be left standing as the winner but succumb to wounds moments later. These two Captains are in the same league.
