For Germany it's because of the special formulation in the constitution.
So because the laws were abused and changed during WW II we decided
on making the important laws such as death penalty in a section that cannot
be changed by a single person. So even if the German President or Chancellor
wanted it they could not make it.

Im american just sayin'

The united states is one of the only "civilized" countries that practices the death penalty, personally I believe there are some cases were it should be aloud, but I believe its thrown around way too much and has way too many flaws and 99% of the time is wrong.
Some people even disgust me with how carelessly they throw it around.

One time while talking with my friends I "jokingly" brought up a scenario (not meant to be a joke but to just ask them a question were I thought the answer was obvious)

my question was "Do you think a mentally handicapped a.k.a. retarded person should be given the death penalty if they killed your family?"

Every single person came to the conclusion that "yes....even if it was a accident" o_O
my friends seemed like rational, logical thinkers so this greatly bothered me.

One of my friends even said "it's not like he doesn't know what he's doing"

I just sat and stared blankly trying to grasp what ideocracy was coming out their mouths.

orange - Retains, though not used for at least 10 years (34)
red - Retains death penalty (58)

the US should really get off the red list it looks weird on it, come to think of it Japan could do something too

Death Penalty is a complex concept . . . we can not grant life to those who didnt deserve death and thus it does not gives us the right to take away the life of even those who deserve death . . . but personally i think death penalty has merit in certain cases: A homicidal lunatic may not know whats he is doing (some pretend to be lunatic) . . . but letting him live poses danger to other innocents and plus a huge amount of resources are wasted after that lunatic when children in Africa is starving to death . . . so death penalty may seem appropriate but my heart still says no...... Its better if a system is developed where the offender works for their food and shelter in prison, and the hardcore criminals spend the rest of their lives in hard labor and community service. This is a better way of repentance and use of resouces in my opinion.

In Japan it isn't practiced a lot anymore. Besides when they thought about removing the death penalty, they let the people decide and around 70% wanted to keep the death penalty.
Anyway, Europe probably doesn't consider it civilized. Plus if someone was framed or so and that person got the death penalty then they can't turn the time back to put the right person on the death penalty. They want to make sure that they don't put an innocent person to death.
Although for some criminals it would be better for society I think if they got the death penalty

because they are a part of our history and represent countries like the UK to the world but we all have democratically elected governments and the most power goes to the leader of it - prime minister and NOT the monarch

Till recently, relatively seen, a lot of European countries had it, but it got abolished in most of them. I don't really see why we should have kept it as it's quite inhumane.

Why does Europe still have a stupid ass Monarch, ask yourself that.
You do realize that Europe is not a country? But actually consists of quite a large number of them and that it depends from country to country whether they're a monarchy or a republic?

i dont know but i think they should do it not because it is something old and primitive no think about this imagine if you a women got raped what would be the sentance 10 yrs people would say frequently or more ok now imagine if you just discovered it was you 50 year old mother no what would you do pain death lol even know thats too much but just think would the rate of rape in the western countries increase or decress it will make rapesest shivver in fear which they diserve for touching a women that goes for pedos etc we are too soft on them they do it aagain after release becuase thats all they must of been thinking in prison which will make them more worse

Because unlike in the US, in Europe we don't believe it's right to murder people who have the IQ of a 5 year old.

I'll admit in some cases it almost feels more right to murder some of the convicts we have, like the Norwegian shooter, but it seems it's probably better to jail him with a PS3 for 10 years to 'teach him a lesson'. Pretty sure the dead kids parents would rather beat him to death but we're more civilized than that.

In a nutshell: We believe being alive is more of a punishment than a quick death.

Indeed. I can perfectly understand why people would want to punish someone with death when he did something really horrible like Breivik or Holmes. However in the end you are just killing him too. Subconsciously you're actually saying that there is not so much wrong with the act of killing someone itself, but just with the reasons why you're killing someone.

Of course you also need to take into consideration the exact circumstances of the crimes that were committed.

and not just one!

many things european (whatever 'european' actually means, apart from a geographical term) are not de facto a sign of a civilized or advanced society. imo, it would be best for many reasons to ask for specific european countries why they abolished the death penalty. there are usually relevant historical, political and legal reasons behind it, but it's best to be more specific.

the first act toward a civilized society was the consensus between humans not to kill each other, we all waved a certain part of our freedom so that we are able to live in a (lets say) prosperous society (compared to what we were before). And with the act of capital punishment the very institution that is supposed to uphold the norms of our civilization, the government, is breaking the most fundamental and the first norm that we set to build our future on as a civilized race.
