Well don't jump to conclusions here. For it to indeed be Tobi's Rinnegan that means he's a different character entirely....

For me its simple. Madara died shortly after giving Nagato his Rinnegan. Tobi is a Zetsu clone (possibly the first Zetsu) that took on traits of Madara via his DNA and basically shares the same personality, but not the same soul. The way I see it, Madara and Madara's clone have been working together for a while and Tobi basically considers himself a shell of Madara.....

Anyway I think that the Rinnegan Tobi is using now is the orginal Madara's and the reason he's using Sharingan-Rinnegan combo is because, like Nagato, he can't turn off his rinnegan due to transplantation. Simple right?

Sig is funny, but no I don't think that you need EMS to unlock the Rinnegan for sure. The things you do need is Senju and Uchiha powers that gives you Rinnegan that's how Tobi gave Nagato the Rinnegan according to tobi because Nagato had the Rinnegan from birth remember he unlocked it first when his mother and father died so ya I am thinking that tobi has lied to us about Giving Nagato the Rinnegan and about being Uchiha Madara!!!
