Would Obito/Madara have been spared?

Obito, yes. Madara, probably not, first of all he's the cause of all this he manipulated children orchestrated the death of a little girl and destroyed the lives of countless people and started wars for his own ambitions. He did it all without repentance or remorse. And judging by the will and stubbornness of Indra he'd do it all again. He's not like Obito or even Sasuke not by a long shot. Madara is pure evil.

Killing off people and starting a war because of a girl is not cute. Lol

And orchestrating the death of an innocent young girl in order to manipulate a child into doing your bidding isn't cute either.

well madara wouldve probarly never give up figting soo he probarly had to die anyway but no naruto or sasuke never would let him live

obito would be spared because of kakashi becoming the hokage and naruto Thinks for some reason he are the coolest guy even if its his fault for minatos and kushinas Death and he attacked the hidden leaf and moore

I believe that neither Obito or Madara would be spared, and I would like to discuss the reasons individually.

Let us first consider Madara. He described himself as a ghost of the Uchiha, and this should be interpreted as such: a ghost of the Uchiha before they were, in his eyes, "tamed" by the ideals of Senju Hashirama. Madara held onto his hate and allowed it to take root in that underground that he lived in since his fight with Hashirama. He brought the Gedo Mazo from the moon, manipulated the circumstances of Rin's death/Obito's fall, and after his revival he was directly responsible for the deaths of many shinobi. Madara was even able to cast the mugen tsukuyomi on the world and up to his death showed no regrets. There was no way that he would be allowed to live, not if Naruto truly wanted peace with the other villages. As the man that effectively destroyed the world, they would never allow Madara to live.

Obito would not have been spared either. He is the man that became "Madara" and accomplished more that the original in fewer years. Obito's crimes include manipulating Kirigakure, attacking Konohagakure by releasing the nine tails, forming and secretly controlling the Akatsuki, assisting in the Uchiha clan's genocide, the fourth ninja war, and most importantly, reviving the ten tails. Despite re-igniting his will of fire shortly before his reduction to ash (almost poetic) and being invaluable to the defeat of Kaguya, that does not erase the fact that he caused the issue in the first place. There was literally no way for Obito to redeem himself that did not include him dying, and as with Madara, the world would not accept him living. Kakashi would not be able to excuse Obito within Konohagakure, much less the rest of the world. He and Naruto would only lose face trying to attempt it.

Many might then try to bring up Sasuke's pardon, but Sasuke's, Obito's, and Madara's effects on the world were VERY different. Sasuke was forgiven because he himself started on his path as a victim of Madara and Obito's plot. He was also young, becoming a runaway ninja at the age of 13. He then came unto the world's microscope for three GOOD reasons ("killing" Orochimaru, "killing" Deidara, and "killing" Itachi. All INTERNATIONAL criminals.) Sasuke then joined Akatsuki and attacked the Kumogakure jinchuuriki, followed up by attacking the gokage kaidan. However this resulted in the deaths of...Danzo (someone that was caught trying to manipulate Mifune) and samurai (who attacked him first, despite Sasuke being wrong for being there in the first place.) And then Sasuke assisted in fighting against Obito, Madara, the ten tails, and the mugen tsukuyomi. He was redeemable because despite doing bad, he usually did something that had to be grudgingly accepted as good RIGHT AFTER.

In any case, Madara and Obito had no chance of being spared, while the not even a legal adult Sasuke was barely forgiven.

how would you imprison Madara...

Easy just put the chakra seals over his eyes like they did Sasuke. Don't forget Madara without his stolen Juubi power is a million times weaker than Sasuke with his sage given rinnegan and that's even when Madara has hashi's cells. Madara without Juubi shouldn't be a problem for Konoha to imprision and if the bum somehow manages to escape naruto will kick his ass. I'm pretty sure the madara who got spit out by Kaguya couldn't even take on aye or onoki. Without juubi power or edit immortality he's VERY stoppable.

I believe that while Obito may have indeed been forgiven by Kakashi, he would not be forgiven by the rest of the world. He would live his life in his cave, occasionally popping out to help the leaf, a path similar to Sasuke's road to redemption.

Madara on the other hand was unrepentant until the end. He would not be forgiven nor want to be forgiven.
