Would Obito/Madara have been spared?

This episode's discussion in between Orochimaru and Sasuke brought some thoughts to mind. Had Obito lived through the Fourth Great Ninja War, would he have been sparred like Kabuto, Orochimaru and Sasuke or would he have been locked up or executed? What about Madara?

In my opinion it would very unrealistic if they were, just as I think Kabuto & Orochimaru not being held accountable got their actions is also unrealistic but then again Kabuto is a nun! On Topic: no they wouldn't have been speared if the powers at be (Previous Kages) made the decision.
