That tie up comes mid way in the Lotus. There's plenty of time before that to perform the hand signs. And performing the Lotus on Sasuke won't be as easy as Gaara anyway.

Performing it againts Gaara wasn't easy either.

Sasuke has more changes of beating Lee early on the battle, he is better all around.
If I had to give the fight to someone, I would give it to Sasuke most of the time.
But if Lee manages to enter the 5th Gate, Sasuke would have no chance.

Lee can't do much even with 5th Gate. He won't be able to speed charge at Sasuke because he'll be massively vulnerable if Sasuke activates Chidori since he'll provide the thrust himself. That combined with the fact that CM enhanced durability will be able to take some hits and CM enhanced raw speed combined with the Sharingan will be able to evade some hits. That's a solid combo on Sasuke's side. If anything, they'll be in an equally bad condition, if it all goes well for Lee.

He has done it againts Sasuke with Sharingan before.

CM1 wont bridge the gap in speed. Nor does it significantly increase durability.

Like i said before the only way Sasuke that is winning is vote 1 sasuke. Which is 3TM CM2 Sasuke. That's the only Sasuke that can beat Lee, period. Lee would still win even if 5th gate destroys his body. Enough to walk away after he's finished pummeling Sasuke. Lee was fine enough to walk after the assault on Gaara and the only reason he was hospitalized was because of the sand coffin.
