You can only be summoned by ET if your soul has passed, hence why the 4th didn't work. By Oro placing part of himself in curse marks his soul never reaches peace to be summoned.

His soul wouldn't go to the after life, if he dies he'll revive himself by taking over the body of someone with his Curse Seal. Sasuke and Itachi both killed him and he came back.

Whatever you gotta tell yourself at night buddy. What really happened was his current body was trapped in Totsuka while his soul/consciousness/being went into the curse marks. Theoretically he could have been brought back from any body with a curse mark not specifically Anko.

Probably the way ET works and the first come first serve concept. Whichever curse mark was activated just a fraction of a second quicker would be the one(only of the 2) that brings him back.

The Orochimaru we all know and see presently, Orochimaru didn't die, he was just sealed and thanks to his curse mark on Anko, he was released, if the true, original Orochimaru was dead and the present is simply a clone, he wouldn't need to get his arms back from Shinigami, his soul would have been complete.

Totsuka traps the soul and consciousness specifically, not just the body.

It's the same as Minato and Kushina being inside of Naruto's mind, with the difference being that they were not revived inside a body.
