How is Kabuto above Iachi when Itachi beat him and how is Kabuto above Orochimaru when he needed Orochimaru DNA(and others) to achieve his greatest form

because he is still stronger than itachi in spite of the way his fight scripted out

You can't be stronger than someone when you're dependent on their existence for your power. While Oro is alive Kabuto can not be at his best so therefore Kabuto is only above Oro after Oro is dead.

He needed Oro cells to harness sage mode and the other modifications. If he could have gotten them while Oro was alive he would have. Plus once Oro came back he took his energy back from Kabuto and Kabuto reverted from his sage mode. Kabuto only attained sage mode because of his Oro alterations. Oro being alive means he can't make those alterations.

nah, Kabuto should still have oros dna & body modifications.

furthermore, oro was fully revived w/o taking the leftover chakra from him anyway. it turns out he was split inside the seals & revived when it was convenient for the plot, independent of kabutos conditions

Just to point out, the feat did not pop out of nowhere.
When Itachi fought Sasuke, even tho Sasuke had absorbed Orochimaru, the latter did come out of the curse mark.
Once he was out, the curse mark disappeared, implying that part of him was always there, even before being absorbed.
The fact that it was Sasuke who forced Orochimaru out of Anko, wich is similar to how Itachi forced him out of Sasuke help the argument even more.

And I do think Orochimaru is underrated.
The guy/girl/it looks younger than ever in Boruto Gaiden.
