Yeah hypocrisy is a norm in society. Not every person lives up to there religion. In reality you can't, cause even something as little as anger is a sin. Yet we make those all the time. That is why I told my one aunt that it is not the number of good deeds you have that will take you to heaven it is the quality of those good deeds that will matter in the end. In this case even if you are non-religious you could have those quality good deeds.

These women who were raped were, quite clearly, 'those whom your right hand possesses.' It is important to note that the terminology used does not necessarily mean one who is permanently a slave - but one who is simply under one's control or authority.

The full story:

Book 008, Number 3432:

Abu Sa'id al-Khudri (Allah her pleased with him) reported that at the Battle of Hanain Allah's Messenger (may peace be upon him) sent an army to Autas and encountered the enemy and fought with them. Having overcome them and taken them captives, the Companions of Allah's Messenger (may peace te upon him) seemed to refrain from having intercourse with captive women because of their husbands being polytheists. Then Allah, Most High, sent down regarding that:" And women already married, except those whom your right hands possess (iv. 24)" (i. e. they were lawful for them when their 'Idda period came to an end).



As you can see, this event took place after the battle of Hunayn.

The conquest of Mecca astounded both the Arabs and other tribes. The Hawazins had been long-standing enemies of Meccans. Given this history they saw Muhammad as another powerful Quraish leader who had come to lead his people. They thought among themselves that a war with Muslims was imminent and that the once persecuted minority of Muslims had gained an upper hand against their non-Muslim Arab enemies. Some tribes favoured fighting him and the Muslims. Ahead of these were the tribes of Hawazin and Thaqif. So, they met Malik bin ‘Awf An-Nasri and made up their minds to proceed fighting against the Muslims. Malik persuaded other tribes to fight and gathered them before him. The confederation of tribes consistiing of Nasr, Jusham, Sa‘d bin Bakr, Bani Hilal, Bani 'Amr bin Amir and Bani 'Awf bin Amir gathered at Autas along with the Thaqif and Hawazin.



1) Once again, muslims were attacked, but they won thanks to Allah. So the enemy can only blame but themselves for falling captive to muslims. The hadith talks about the ruling that falling into captivity invalidates the already existing marriage of captives, so that they can be re-married to muslims.

2) This hadith nowhere says though that the female captives were raped.

3) The verse quoted in the hadith is surah an-Nisa ayah 24. The full ruling goes like this:

Prohibited to you [for marriage] are your mothers, your daughters, your sisters, your father's sisters, your mother's sisters, your brother's daughters, your sister's daughters, your [milk] mothers who nursed you, your sisters through nursing, your wives' mothers, and your step-daughters under your guardianship [born] of your wives unto whom you have gone in. But if you have not gone in unto them, there is no sin upon you. And [also prohibited are] the wives of your sons who are from your [own] loins, and that you take [in marriage] two sisters simultaneously, except for what has already occurred. Indeed, Allah is ever Forgiving and Merciful.
And [also prohibited to you are all] married women except those your right hands possess. [This is] the decree of Allah upon you. And lawful to you are [all others] beyond these, [provided] that you seek them [in marriage] with [gifts from] your property, desiring chastity, not unlawful sexual intercourse. So for whatever you enjoy [of marriage] from them, give them their due compensation as an obligation. And there is no blame upon you for what you mutually agree to beyond the obligation. Indeed, Allah is ever Knowing and Wise.
And whoever among you cannot [find] the means to marry free, believing women, then [he may marry] from those whom your right hands possess of believing slave girls. And Allah is most knowing about your faith. You [believers] are of one another. So marry them with the permission of their people and give them their due compensation according to what is acceptable. [They should be] chaste, neither [of] those who commit unlawful intercourse randomly nor those who take [secret] lovers. But once they are sheltered in marriage, if they should commit adultery, then for them is half the punishment for free [unmarried] women. This [allowance] is for him among you who fears sin, but to be patient is better for you. And Allah is Forgiving and Merciful.

This section talks about marriage, not ***.

So does 4:3 :

And if you fear that you will not deal justly with the orphan girls, then marry those that please you of [other] women, two or three or four. But if you fear that you will not be just, then [marry only] one or those your right hand possesses. That is more suitable that you may not incline [to injustice].

Then there is this:

But let them who find not [the means for] marriage abstain [from sexual relations] until Allah enriches them from His bounty. And those who seek a contract [for eventual emancipation] from among whom your right hands possess - then make a contract with them if you know there is within them goodness and give them from the wealth of Allah which He has given you. And do not compel your slave girls to prostitution, if they desire chastity, to seek [thereby] the temporary interests of worldly life. And if someone should compel them, then indeed, Allah is [to them], after their compulsion, Forgiving and Merciful.



Note that these are Medinan surahs.

23:5-6 is Meccan. In the early period it was allowed to have *** with the slaves the arabs already had, because it would have been hard to rule that out overnight. But note that in the Meccan period, muslims didn't engage in battles. It was only in teh medinan period when they were allowed to fight back, and that's how they could capture captives- whom they could marry. Not rape.

4) In any case, the current events in Germany have nothing to do with it, as the migrants /refugees there have no women in their right hands' posession (as slavery is universally abolished- at least, legally).

I don't want people to accuse me (again) of being a 'rape apologist', so let me say that without trying to justify the actions of these people or belittling the gravity of the fear of women attacked...only one case reported fit the legal definition of rape, so let's not exaggerate. Also let's not generalize (I'm not saying OP did or anyone else specifically, just in general let's not generalize [no pun intended]), Germany last year alone took in some 1 million migrants/refugees, so let's not make assumptions about the cultures of the 999 000 based on the actions of a 1000. Notwithstanding that this is not the only time when horny young men from abroad committed sexual crimes. But to blame it on islam is stupid. Drinking alcohol is against islam, touching non-mahram women is against islam, men and women can't even shake hands or talk unnecessarily. The Quran tells both men and women to lower their gaze and protect their private parts outside marriage.

I think the problem here isn't with Islam as formally constructed, but the muslim immigrants.

The problem lies in poor regulation on how these immigrants move and where. Just letting anyone in and giving them social help, while humane, is a naive thing to do. Check the records and keep them close. It's ridiculous how in some cases immigrants aren't even listed in so you have no clue who came in, from where or how. Not even if they left the country.

That's where I believe the problem lies.

OT: It's a disgusting act and those who try to downplay it are just as bad.
