Orochimaru was under Yamato watch, Naruto with his god power could easily sentenced him to jail if he wanted to but as usual he gives him chance just by the way it was portrayed. Look if this is how Kishi envision to end this series like that, then it's conclude that Orochimaru is only doing for his own interest which is different matter compare how he used to be since he no longer involve the others. I remember there were some spoiler about the boruto movie that Orochimaru send Mitsuki to become resident of the Leaf because he doesn't want his own kid to become like him something along the line. From the very beginning it was always established that Orochimaru used his own subordinated as his puppet for his experiment but he could've done to his own child if he wanted to do it and make him a spy or something but no instead he wanted Mitsuki to become the new leaf.

Orochimaru is just like Kirusutchi from Bleach, this guy was once a criminal but now he become the head of the scientist in soul society
