If you still on the middle aged hero, the robber will not be charged with premeditated murder. Premeditated murder apply to those who knew who to kill. A robber never know who he gonna kill, he will have to determine if he suppose to kill the person or not. If you accuse him of ready to kill whoever, its not entirely correct.
