In a case of rape I would usually tear the perpetrator to tiny shreds but this kid is obviously very, very, very disturbed. It is a highly unusual case, I have never heard of it before.

I blame pornography for this , if that mom always check on him , she must've known , what this guy do right and she often comes drunk that's not a good behavior for a mom either as much as one should blame this guy , they should blame that mother as well .

The boy may have been in the wrong, but it's quite obvious that the woman was a shitty mother if I read the situation correctly.(she probably came home drunk a lot) As a general rule of thumb, if the parents raise their children in a ****ed up manner, the kids have a high chance of becoming ****ed up themselves, and this situation illustrates that concept perfectly.

OT - It's one of a kind experience, so they both should relax, shit happens. He did wrong, it's a rape, and mom filed the complaint so who cares?

For one thing, Don is right though, rape is premeditated. He obviously knew his mom came home drunk a lot, checked on him when she got home. Planned it out, left the door open for her to find him undressed and aroused. He must of seen her worse then that night, and probably must of had to put her to bed. Probably touched her and masturbated. He wanted more, and so it led to this night.

In which country you two are from? Because this is the first time I heard that it has to be "premeditated" to be called rape.

Under common law principles it's defined as non consensual *** and even if someone gave their consent at some point but took it away from the moment the consent was taken back other party can be found guilty of rape if they do not stop. ( Of course in such a case proving that consent was taken back may be difficult and all )

Not premeditated in the sense that the boy may not have the intention to rape his own mother. It was the circumstance, that made him choose a bad decision because of bad choices.

The mother is a single mom, I can't erase the thought of her victimizing herself for the hatred of the boy's father. If this mother is truly a caring and loving mother, then she will not put her son in shame. Instead of solving the problem as a family, she sought the advise of the "neighbor" who probably her boyfriend too..

Please take note, the boy was not violent. Rape case is just too much.

I don't think you really understand what constitutes a rape...If he didn't "intend" the act wouldn't have happened. Whether he per-planned it or not isn't the issue here, even remotely. Premeditation would augment additionally on the issue but that doesn't negate what occurred regardless of it.

If the boy was violent that would be additional charge of "battery" ..there are degrees and additional accusations in such cases. What and why of the case are something we cannot decide. Maybe woman handled it badly, maybe not. Drinking is not a good thing in itself and with a son to take care of alone, it won't improve the situation. But rape itself is another matter. Her supposed drinking problem doesn't justify son's actions.

I don't know the circumstances there, but once something like this happens within your home and another family member living in the same home is directly involved there are many other complications. It already made the home not so secure place. Once that taboo is already broken it would always be an unconformable zone on some level even if the incident isn't repeated. Besides there is a high chance that it can happen again.

Edit: What to do and what not to do is never so simple in such a scenario and people have to decide for themselves, whether they make right decisions or wrongs ones. Another source said that his sister was also at home though it was not detail whether she was asleep or what. More reason to at least investigate the case. The boy has been sent for psychic evaluation.

And why are you suggesting about the neighbour being her boy friend..when the news doesn't even state if the neighbour was a male or female... I can see what you are doing that..It's not a nice thing to try to undermine such a crime.

Maybe I should have made myself clear-if the boy raped his mother, then obviously he was copletely at fault and not the mother for this incident.(although coming home drunk didn't help.) It would be the same if it was the father as well.

As far as raising kids is concerned: Yes it's the same with the father. If he's a drunkard who doesn't contribute properly in the household, then it's a big problem with regards to the child's future. You are right that children these days are influenced by a wide range of external factors(mainly the internet) but it doesn't change the fact that if you raise your child properly, the chances of them turning out into productive members in society is far greater than it would be otherwise. (obviously there is no guarantees either way.)

Rape is "the unlawful compelling of a person through physical force or duress to have sexual intercourse." This also includes statutory rape. The fact that she was intoxicated and he was sober is more damning evidence against him. If someone is under the influence of any substance and unable to maintain full consent then it still constitutes as rape (even if they seem participatory in their inebriated state).

This is one of the rare cases.

Rape doesn't have to be planned in advance. Actually, in many cases it happens when the girl is flirting, or allows making out, petting, and the guy just can't stop. But as long as the woman does not consent to ***, it's rape. If she was intoxicated so much that she couldn't give a consent, if the guy abuses her condition, it is also rape, at least in my country.

What mom doesn't check on her son? Even is she was under the influence, I'm sure a habit/reflex made her go to her son's room to check on him. They had probably been having issues within their household, and he decided to hurt her. Who knows, she could have been verbally abusing him (not saying that that's ok for him to rape her).

I think there may be the confusion of murder and rape.
(It's be a while since I've done legal studies so correct me if I'm wrong (the people who actually know what they're talking about))
Murder= the intent to kill (premeditated) and the act itself.
Rape= sexual intercourse when one (or both parties) have not consented. This includes having given consent and then changing your mind. It also includes being taken advantage of an intoxicated being.
1. I don't care if she is a drunk, rape is still rape. I sympathise with any person whose parent/s are alcoholics but it doesn't make it right. As a human being if it was charged with anything less than rape, IMO, would make me feel sick.
2. Incest... Do I really need to say more? The boy would know it wasn't right. Makes me wonder where his father is and how he was raised.
3. As for talking to the neighbour... Maybe she had no one else to turn to. When people hide these matters you're potentially protecting a soon to be serial rapist. He raped his own mother because he was "in the mood" who's to say he won't rape someone else when he's on e again "in the mood". Please don't use that excuse.

This is my opinion going by what I have read. I don't know any of the facts and I believe in innocent until proven guilty. Like I said the mother may have been a drunk but no man or woman should be raped EVER. This however isn't the question you raised. It's whether or not it is considered rape. OF COURSE IT IS, going by these circumstances. She did not give consent, end of story. Whether he intended that day he was going to have sexual intercourse with her or not at the end of the day the crime has be committed (providing all information is correct)
