You know what the conditions are to get an EMS? You need to transplant the eyes of the brother not of some person, and you need have an MS for yourself. Kakashi has non of both

It is MS but it's Obito's and it has to do chakra blah blah... So it's like the bridge between MS and EMS.

Technically, it's never stated that it HAS to be a brother, just someone genetically very close. If Kakashi could find eyes belonging to, say Obito's dad in Madara/Obito's Laboratory, it just might be possible. Not that it would serve any purpose, as the eyes don't seem to be deteriorating in the first place.
