Part 1 standards? They're probably around the same level. Both are extremely smart, and Kakashi gives Kabuto high praise for coming up with such a complex plan at the hospital.

Kakashi surely has more ninjutsu, and even the Sharingan. A Raikiri + Sharingan combo takes up loads of chakra but can easily be worth it. Kabuto doesn't have this vast variety of ninjutsu but instead focuses on medical ninjutsu and equipment. I remember him using at least 2 different types of pills in his fight against Tsunade (one of which increases stamina), so he probably has them in stock given he's a medic. Chakra scalpels seem similar to gentle fist in the regard that a simple touch is all you need. And of course he has the generic earth technique where he can hide underground. Something that a lot of people tend to forget is his Shometsu, which won't heal things like a Raikiri stab but is great for things like injuries via kunai and the like (which is what Kakashi used to make Zabuza's arm lame).

I think Kakashi's genjutsu should be mentioned here. Guy said that he specifically developed methods to not look into his eyes. Kabuto has his own genjutsu but that has its strength spread out a bit more (Kakashi broke through it anyways).

as far as power levels go the first part of Naruto is completely irrelevant

now you have random nobodies doing more damage than 3rd, 1st and 2nd used in their battle, Kishi just decided somwhere down the road to blow it way out of proportions (not complaining though) and thats why hes gonna have trouble with fights and bringing up the power of those who were suppost to be strong but now seem weak (like Hiruzen, in part 1 he was awesome but what he did back then seems trivial now, same goes for summons, but Hiruzen is a Hokage and now Kishi is gonna have to make him relatively equal to the other 3, that could be tricky)

not to mention that by description some of the characters should be unbeatable: like Madara, Obito, Minato ... because the combinations you can do with their jutstus are just insane but for some reason now they dont even use the Rinnegan, if they ised brains and all their abilities at best a fight between them and someone else should be a stalemate ... thats why kishi is gonna have to use plot no jutsu

Most things said by characters are deemed fact because its information given by Kishimoto himself through his characters. Of course there are things that have been proven wrong or just wrong in general, but for the most part , its all true.

God you sound like a broken record. Where did the whole Uchiha Clan and 7 Swordmen come from? Itachi said nothing about them. You're using A>B>C Logic, which doesn't work. The only jutsu Kabuto used that required hand seals are his Chakra Scalpel, and the Temple of Nirvana technique.

First off, he's part of a war, and can't afford to be in a fight in the center of a village where the One Tailed Shukaku was planned to come out. Secondly, he can't have his Temple of Nirvana technique or his Earth Techniques copied, since they are essential parts of the war itself (putting the citizens to sleep).

Finally his Chakra Scalpel, even if Kakashi copies that move, do you really expect him to use it at the same prowess as Kabuto, the medical ninja under the tutelage of Orochimaru and surpassed Part I Tsunade?

The bolded part already proves that you're making assumptions. Kakashi improved greatly between Part I and II, and was able to learn how to use those moves after various points in the manga.

Intelligence is subjunctive, something you know nothing about.

Kabuto made plans to use an Edo Tensei army since all the way back in Part I, and experimenting with various characters [Zabuza & Haku, Fourth Kazekage, Sound Four, Sasuke]

You ended up proving that Part II Kakashi > Part I Kabuto, which is correct, however, you're trying to prove that Part I Kakashi > Part I Kabuto, which is not.
