That is a misconception Yama is the strongest in the gotei 13. I'm sure he has been offered a position in the guard many of time. And turned it down many time because he was the one who started the academy. The royal guard was in place before then or else no one was protecting the king.

Also those who are deemed strong and get promoted from the gotei either go to the nest or to the royal guard. Which means that captains can be promoted even Yama. Yama has kept his position because he is the strongest in the last 1000 years what about before those 1000 years who has come before that the guard.
