(spoiler) since we know now that kakashi got his MS a long time before the naruto series started i was wondering y he has never used it before the time skip?

Obito told him clearly, His MS will NOT work on him.

Plus he was out of chakra that time.

Plot hax aside, it's because he didn't have enough chakra. Remember how he'd pass out in part 1 after just using the normal Sharingan to copy a few techniques? He probably knew he had it in part 1, and just couldn't use it since he wasn't powerful enough.
