[Discussion] Would This Be Illegal?

Here's the question: If I bought $300 bucks worth of candy and recruited several kids, with the permission of their parents, to sell it for me, raising the price of the candy by a $1.00 each and give them a 45% cut of the profits from each recruit, is it illegal? Because I keep getting mixed answers.

I was just thinking that it would be a great idea, plus the kids would be earning some money on the side. I take 55% from the profits that each kid made, buy more candy and take them to other neighborhoods to sell it. Everybody wins.

That's tricky..but as it stands, yes it is illegal. You can't gainfully employ children for any extended period of time. However, it is okay if they volunteer to assist you temporarily. As long as they don't have "shifts" "schedules" or "quotas" they are expected to meet or have any sort of payroll. You can use "prize" incentives like fundraisers do, but not cash or checks.

I'm skeptical anyone would make a big issue out of it though because many businesses break labor laws constantly.

That is illegal. You are operating your own business without licensees and breaking distribution, labor and criminal laws.

He would be breaking Federal Laws if he goes through with it so the FBI would be on his ass, not the cops.

Yes this would be illegal. Any individually packaged item cannot be resold.

Anubis is also right about the issues of not having a business properly registered.

You'll also likely be caught for child employment, tax evasion, etc.

Yeah it's illegal, child labor laws. Of course I never let something illegal stop me in some cases, and in this scenario it could be a lot of good.

But say one of the kids gets kidnapped, or if a kid gets beaten up and robbed for his candy. If bad things happen there's a possibility you could get sued and maybe even jail time depending on your age.

So I would get the parents to sign a consent form saying that you aren't reliable for bad things basically.

I think it would be a better idea to start an official business and instead of kids hire some prostitutes or actors and dress them as prostitutes. Clients order stuff online and prostitutes deliver it. You advertise it to make it look like the clients can get laid with prostitutes if they get lucky.

Giving kids candy to sell without any contracts, with likely no support from their
parents because it isn't schoolbased or for a cause. Nothing can go wrong.

If it's for the cause of money, then it's important #JackNeedsTheMoney Jackbots don't pay for themselves!
