If itachi tries to kill Tobi, Tobi will go intangible and Kamuis to where Sasuke is. And then kills Sasuke. We know Sasuke wasn't strong enough to deal with Tobi at that time.

no its because itachi is a selfish coward who would rather millions of people be slaughtered in a destructive world war than try to kill the greatest threat to his village.
he even let obito into konoha unresisted because of a flimsy deal to help him kill the uchiha. itachi has no problem joining forces with evil murderous terrorists if it suits his own ends even if it puts many many people in danger

there is no "had to" about that you moron. that was itachis plan to make sasuke suffer in agonising pain through vicious brutal mental torture. he didnt have to. he wanted to. to cause sasuke pain and make him suffer.

If tobi had become threat to konoha or came to kill him then only there was a chance.
