Not true. Either way, Obito had a clear chance when Kakashi lost consciousness after he killed Rin. Obito could have taken his eye back and killed Kakashi then, but he didn't for plot reasons. That 'I don't care anymore' excuse Kishi came up with is lame since he cared enough to try and kill Minato and his family for 'not being there to protect Rin' but doesn't kill the person who actually killed her.
