I was reviewing chapter 561, in which Madara tried to summon the Kyuubi.
It's obvious that Tobi and Madara are / were working together and had a common plan, and one part of it was to capture the Bijuu.
Controlling all the Bijuu is not possible, especially for quite some time, so they planned to seal them in the Gedou Mazou (also so the Mazou could be the new body of the Juubi).
Now, if Madara knew they had to seal the captured Bijuu, why did he even try to summon the Kyuubi? Could he summon it out of the Mazou?
I don't believe he was thinking the Kyuubi would be a good boy and cooperate with Tobi so it wouldn't need to be sealed in the Mazou.
And also, it doesn't seem to be possible to control the Kyuubi for a very long period ( ).
Do you agree with me that this might be a mistake / plothole, or can you help me finding an explanation?

he wanted to see if the kyuubi is free or its inside s.one

But if the Kyuubi was sealed in the Mazou it wouldn't have appeared either.
Exactly like it didn't appear as it was sealed in Naruto.
The only option is that he didn't know of the Mazou, but he kind of must have known of it, because as I said, the Bijuu wouldn't be controlable.
Maybe the initial plan was that Tobi sucked them in with his Space-Time-Ninjutsu?

I don't think Tobi has the same plan as madara because like you said if he would have summoned it it would not come out because it is sealed in either the gedo mazo or somebody because why would he only want kurama maybe if his plan only involves kurama??
