Yes, let's hate on Hinata. The Sakura hate is pretty old...She started out useless but now she can fight well. Kishimoto wanted her to be as realistic as possible and not a stereotypical anime girl.

Because of her incompetence.

While I am armed in the service, I am responsible for anything my assigned weapon kills. I am armed, it is my weapon. If someone else were to use my weapon to kill someone - I would be put on trial by a court martial. If another individual (other than myself) were to be seen holding that weapon by the 'right' (or wrong, in my case) officials - it could end my career.

There are some circumstances/conditions where this concept is not actively enforced - but you're still responsible for your weapon.

Trying to argue that it was "Sasuke who poisoned him" is implying that it was Sasuke who poisoned the kunai and it was his intention to poison Naruto.
