yh good theory. With the noticable difference of Sasuke's EM color scheme to all other's like Itachi and Kakashi's its very plausible to think that the structure/form could also differ.

I think it would be kind of like a mix of Rinnegan abilities + unique EMS abilities. Perhaps he was the first one to have the Amaterasu + Tsukuyomi = Susano'o combo?

He didn't need to steal eyes. He was born with the EMS, his brother had the cells to give him Rinnegan. Make sense?

I think it's just the first mutation of the rinnegan with only yin chakra and not yang chakra since the elder son only inherited yin chakra

Well, two things are wrong with this theory.
#1 It is implied that the Sage passed on those exact eyes onto his Son.
#2 He would have to have taken eyes from another person (Uchiha bloodline) to create the EMS. It is only known that two of those brothers existed. He would have to have taken eyes from a son or grandson or something.

It isn't, cuz my theory implies that he was born with the EMS. His brother's cells would have given him the Rinnegan, like Madara got it after getting Hashirama's cells. Make sense?
Over the course of hundreds of years his eyes got diluted and turned into the Sharingan. That's when all the conditions emerged for the progression into the MS and the EMS.
