My point is he can't be his transmigrant if he is still around. Ashura and Indra died but they reside in body influencing their decisions

Thats Ashura and Indra; not Hagoromo.
In the same way Madara was no Hagoromo either; He was merely a mix of both of Hagoromo's sons', and was áctually ment for reviving Kaguya.
