What's ironic is Tobirama spoke of "Democracy" in front of Hashirama.. right. And Saying the people of the country and the village want him to be the leader. And that he can't go against that.

However, what happened to Tobirama's belief's here:

I was thinking about that yesterday. The current Kage can elect his successor. It's only if the current Kage has died in battle and didnt get a chance to elect a successor that democry steps in.

All hashirama had to do was elect Madara as his successor right after he was chosen to become hokage.

good idea , but i'm against - madara being leader.
it won't be good for village.

any way tobirama did make wrong decision here in the 1st glance
but things might have changed , hokage might have the power to do so in such conditions ,
according to constitution ofc lol

the time when konoha was founded was a different , there was no constitution .
