jutsus are forbidden to discourage others copying them and increasing the usage of it, but at the time of life and death matters all of that is thrown out of the window and you see a lot of ninjas pulling out forbidden jutsus to save their ass

tobirama did not die against the brothers, he could easily have forbidden the jutsu later on and its also not like using paper bombs will help, the kyuubi shroud has withstood more destructive jutsus

no he didnt. the only person tobirama cares about is himself. he loves the jutsu and shrugged when his brother told him off for being immoral. wahts more there is LITERALLY no manga evidence tobirama made it forbidden, only that it was.
and yes he was using it on kin and gin which is why they know what the jutsu is.
