No, he simply created a jutsu to use in the constant war that he was in. Orochimaru looked it up and took it up as his own and improved it. For you to blame Tobirama is to blame the Sage for passing on ninjutsu to others. The war is the fault of everyone in Akatsuki

But if he never made the justu in the first place orochimuru wouldn't be able to "improve the justu"
