To start off a good statement by someone on another forum regarding my theory. I don't necessarily agree with the first statement but after that I think it's very good and pay close attention to the bolded.
A response to another good question which I forgot to originally address.
Understandable. But it's the truth. He is a nobody. At least in this era. He is nothing but a relic from the past forgotten over the generations. If even the Sage of Six Paths existence can be forgotten (or hidden) and chalked up to nothing but myth by the bulk of society then what more of his sons? Hell he is called the sage, a descriptive name not a true one, and they are called sons. Nobody even knows their specific names in the same way the bijuu names were forgotten.
He used Madara's identity because Madara was a powerful, relevant name in this current era and that's what one could use to get things done. The elder son, even if he came without a mask couldn't do much in terms of moving people, especially those members of Akatsuki. Not without a valid display of power which he admits to no longer having much of. Despite this he had knowledge of generations and he needed resources or others with power to help him achieve his goals which is why he's such a big recruiter. In order to recruit one cannot simply approach such powerful individuals with no identity or strong ideals. However if he presented himself as somebody admirable and powerful then things become easier. There is reason I believe the chapter was called "The Power in a Name".
What I've just described is the power a relevant name can have and quite possibly the real importance behind the chapter name.
He also claims to have given Nagato the Rinnegan in order to fulfill a certain duty.
I will support all this with panels later but I feel the people here are all knowledgeable and will remember what I'm talking about or else you have no business debating.
After Nagato's betrayal he states he didn't know he would use Gedou Rinne Tensei like he did and suggests that he was betrayed. Now this indicates that he had been prepping him for something. We can now fairly assume that it was Madara's true resurrection. He actually admits to trusting Nagato. Now can you think of why he would allow or trust someone else to execute such a delicate and important task? This is something you or I would definitely do by ourselves in such a situation right?
The fact is he could not do it himself. The guys has admitted to being a shell of his former self.
All these being things he may have been able to do in his prime hence his giving Nagato (and subsequently reclaiming) those eyes which were probably bred in the living Madara.

But I believe Tobi is a creation using Izanagi.
The SO6p created tailed beasts with their own unique personalities and memories (later) of the SO6p.
The SO6p used izanagi to do so... The "yin" to create form\imagination (kinda like the uchiha for genjutsu) and the "yang" to give life to his creation (kinda like the senju).
He used the 10Tail as the source of the yang power and his mind as the yin.
SO, with that said, once Madara got the rinnegan...
He used Izanagi to create Tobi using the "yin", passed on some of his will amongst other things.
He used some of the 1st's power to provide life "yang". (<-- edit)
Hence why Tobi is a shell of Madara. He is created in Madara's image somewhat, but lacks the true soul of Madara (proof is Kabuto summoned Madara).
Madara also told Tobi to use Nagato as a pawn to grow the rinnegan and later use it to revive Madara amongst other things . (Hence Madara instantly thinking of Nagato when he was awoken as an edo, quickly to learn it wasn't Nagato tho).
I also believe Madara didn't die until sometime after akatasuki was officialy formed.

The Mangekyō Sharingan is acquired through the trauma experienced from the death of the person closest to the Sharingan user. With the user normally having to witness or experience this first hand, Uchiha throughout history have killed the person closest to them in order to expedite this process ,hough how Kakashi and Shisui gained their respective Mangekyō Sharingan has yet to be explained. To obtain the Mangekyō Sharingan, one must feel the emotion of losing a friend or family, as merely killing them or watching them die will not activate it.
