Remember, Orochimaru only killed/posed as the 4th Kazekage to get close to Hiruzen during the chunnin finals, Tobi acctually did what he did for control over the village, So I can see why people would affiliate him with the village but not orochimaru

This. Tobi controlled the village for years (?) on end, whereas Orochimaru was only "Kazekage" for a few months at best.
