Ok I said I know who tobi was and I was going to make a real theory for it ok, so here goes
Firstly Lets get trivia out of the way, appearance many people look like tobi, two of those people lost one eye of them is too young.
The two people are Obito uchiha and Shisui Uchiha.
Now, for the solid theory.
1. Shisui Uchiha is renowned among the uchiha clan for having one of the most powerful genjustu abilities in their clan, he activated the mangekyo sharingan, only one mangekyo sharingan two sharingan users have stayed buried in narutoverse history, on of them izuna uchiha is too old to be around now.
2. Shisui uchiha has a powerful unique genjutsu capable of tricking the person that does not even allow the person to know they are under a genjutsu and has them do what ever he wants them to do, he could have used this on itachi and tricking him into thinking that he took his eyes.
3. Itachi claims he took Shisui's eyes yet during his fight with sasuke he is clearly losing sight, indicating that he did not infact take his eyes
4. Tobi managed to get the assitance of many powerful missing nin, now we can assume that they simply agreed with him, but the possibility that he used
Kotoamatsukami
5. Tobi many many times throughout the narutoverse has been shown as having great powers of manipulation, lying to get people to do what he wants them to do, but what if it's more it's most likely that this is part of Shisui's genjustu.
6. Tobi and his intangibility, Shisui and his body flicker tech, as well as being know for his powerful genjutsu he is also know for being a great master of the body flicker The Body Flicker Technique, a high-speed movement technique, allowing a ninja to move short to long distances at an almost untraceable speed. To an observer, it appears as if the user has teleported.
If this is used over a short distance say of the space of a meter or two, it would seem as if the user is intangible, as if you passed right though them.
7. Shisui Uchiha is old enough to have been responsible for the attack on Konoha, he has used the Kotoamatsukami atleast twice in his life time, he have to allow for enough time for him to have awakened the mangekyo sharingan, and the time it takes before the jutsu can be used once more.
taking him to the age of around 35, assuming that he became a prodigy by even uchiha standards, joined the anbu, and fought with Ao at the age very early age of 15.
8. If Shisui got his hands on Hashirama's DNA, which is possible for a chakra sensing able kekkei genkai type holder, (especial if kabuto could do it), then this would lower the time required to use Kotoamatsukami from a decade to a few hours, it may also access a whole mess of abilities as we have seen from others who have been able to do so.
So that's who I think Tobi is, of all the people that he could be, I think this one has the least stretch.

Kagami did not activate the Mangekyo sharingan, nor does he have a history of brilliance, kishi seems to have a brilliance gives birth to brilliance philosophy with narutoverse.
