Yep, Tobi should definately have the MS, for reasons which I believe are rather obvious.

tobi cant use MS so i dont think he can use tsukuyomi, all i've saw him use is a 3 tomo.

Just because that is all we have seen him use does not mean he does not have it. Surely he has MS or there is some other way to do tsukuyomi.
