there shouldn't be craters on the top of the new moon, why would there be it was just created now. Unless this thing is spinning around as it's being created?

I think it's spinning around while being made (otherwise how would the top get even mass?) and as new rocks hit they make craters and the dust covers the old ones in the proximity.
