Sasuke possessing the Eternal Mangekyou Sharingan is a given fact - we know it is true as we've seen him activate the power and such but is it really a given? I am under the assumption that he has lost his ability to use the EMS and it has gone back to the Mangekyou Sharingan.

Sasuke didn't use his Eternal Mangekyou Sharingan. Funny, he was in the presence of the God(s) of Shinobi and he decides to show off his MS instead of his EMS. That's right, Izanami. I think because Itachi used Izanami, Itachi might have (un)intentionally disabled Sasuke's Sharingan because he used a jutsu which makes one of his eyes lose its light and due to a connection between the two, the EMS has been lost.
This is where the power up part comes in. Well we know that Obito has a spare Rinnegan locked up in his little base. We saw that Orochimaru absorbed Kabuto Cells back into him, and I think his knowledge went along with that. Kabuto probably knew the location of where the Obito Lab is.
Sasuke will probably realize that his eyes are gone and will ask Orochimaru to give him the Rinnegan, as he asked ago I for the EMS. Once he gets the Rinnegan, the mix of the Sage of Six Paths genetics and the Uchiha genetics, a new power will be born...
