Believe it or not, I see your point. However, Tobirama was dead the next day and as you said, the people probably still voted. By the looks of it, he was more or less estimating that Hiruzen would be voted in. There is either that, or the leaf being at war meant the people not having the time to vote and the village requiring a leader immediately, and Tobirama saw Hiruzen as being the most qualified. Basically like the vice president taking over for the president if he is killed and then the secretaries and so on and so forth.
