I think it would work if he was Materialized, but if he was in Water Form it wouldn't work.

kabuto is a scientist and its been shown oro and kabuto have already found a way to beat him/keep him imprisoned. kabuto has scrolls and such that can probably seal him up.
from whats shown, suigetsu could tank kabutos hits but kabuto would outlast him due to his regen and high skill/dodging

That restriction is pretty weird

Part 1 kabuto has only shown medical ninjutsu, by feats feats he goes down against suigetsu. But kabuto does have full knowledge on suigetsu by default (as suigetsu was orochimaru's test subject), so he might be able to pull off something to win. I say Kabuto wins
