Well yeah but even without he's clearly on the list and also a friendly reminder that even if people lower on the top 10 like Itachi or Tobirama got the 10 Tails it would destroy them, Obito's own skill and willpower barely stopped him from being torn apart by the 10 tails upon trying to become it's host.

The 2 people who got the 10 tails definitely earned/deserved it.
