OP meant that Madara and Tobi have different chakra, thus 2 different people.
Kyubi recognized the masked guy that controlled him 16 years ago as Madara and the Edo guy as Madara as well.
But as of late Kyubi has not not mentioned the masked guy being Madara, meaning the one that fought Minato was really Madara and after that some fake

Well madara uses the summoning technique because he already has the fox under his control, like if you have it controlled then you can summon it. BTW: He only tried to summon it, i guessed tobi could of tried too, but he already knew the fox was sealed. Madara didnt know it was sealed or not so he just tried.
