Tobi can't see the difference between the original and a clone, so it's greatly possible that he was mistaken. You can even notice that he is surprised when Madara says the one they face is a clone. Madara said he was able to identify Hashiramas clones with his eyes, so it's possible that he is able to identify Narutos clone also

I don't think he had the time to kill the clone at that moment since directly after that his mask exploded so, he came back to the real dimension and had a talk with the rest of the group
