derivative art not intended to annoy another member, isn't against the rules.

Edited. Nevermind. You said "derivative." My mind drew a blank for a second. Mods do not normally delete an avatar for plagiarism unless contacted by another member. That or your avatar contains sexual or violent depictions that may not be appropriate for the site.

Um, which rules? Are you entering a contest? Or are you making an avatar?

Art contest rules are have not that strict aside from using an image editor like Gimp or Photoshop to manipulate the art. Anymore question regarding that, I refer to you this thread:

The problem you could be having with your avatar is the dimensions which are 150x200 (500.0 kb) for regular members. The dimensions change for Premium members which are 150x350.

In your particular case- you have been constantly mimicking another user's ava only to tease him. It can be classed as a form of harassment. Thus even if you feel he kind of invites such courtesy due to his own behaviour, it's problematic.
