That's a fail comparison, Pein tried to capture Naruto and didn't lose, he killed himself. Nagato>Pein, Naruto stated this himself and he still counters Minato's jutsu.

I think Top 5 is a bit too high compared to some of the other powerful characters in the series.
He's probably better suited in 6th or 7th place, but he's definitely Top 10 material.
