i doubt Obito would've been able to get off the hook so easily, considering all of the deaths he is personally and indirectly responsible for. I don't see the other villages humoring the idea of letting Obito return to Konoha, whether the pitch came from Kakashi or Naruto. And i think Obito knew it.
