Yeah but as we saw that was for only Obito's Ten Tails. As for Madara he got the whole eight tails. But also although he help created it his change in attitude also helped in the defeat of the ten tails as we saw. He wants to get rid of it now.

Who alive even has the strength to be able to punish Sasuke. Sasuke is too strong to be punished unless he willingly takes it.

Regardless of that Sasuke deserves to be forgiven, as he is a war hero and world hero, as long as he doesn't go all traitorous again. Sasuke for Hokage.

Naruto is still stronger atm and could easily force Sasuke to stay if he were to try to retreat to avoid justice. Sasuke couldn't simply stay in the village and never fear repercussion, if there were people hell bent on Sasuke's punishment, it would happen one way or the other. I think Sasuke will have to face justice, but others will back him up, most notably Naruto.
