To be honest there are a lot of contradictions and problems in both arguments here. Personally I think that it's just one of those things where there is no clear yes or no answer as what is deemed right or wrong is dependant entirely in the individual and their ideologies as well as their philosophy.

Different groups assume power in governments though, so there's clear objectivity in saying they shouldn't be silenced by law. It's in everyone's interest to not have a government gain the power to take away free speech. Of course everyone else could only be on the receiving end if they elected an asswipe, but, in the same vein, this is true to many limitations already posed on governments by bills of rights.
